Giveaway Terms & Conditions

The promoter is a company operated in the Republic of Cyprus, under company registration number 428214, and whose registered office is at 25 Serifou, Allure Center 11, Office No. 11-12, 2nd Floor, 3046 Zakaki, Limassol, Republic of Cyprus ("MacPaw"). If you participate in our promotions and giveaways (the "Giveaways"), you fully accept these general terms and conditions of MacPaw, and you acknowledge that you fulfill all eligibility requirements.

Eligibility

If you are at least 18 years old, you are eligible to take part in the Giveaways. If you are under the age of 18, you will have to obtain the approval of your parents or legal guardians to enter the Giveaways. MacPaw may ask you, at any stage, to provide us with proof of age and/or identity and/or proof of such approval, if relevant. MacPaw reserves the right to exclude any participants who are not able to provide us with such proof. We also reserve the right to revoke your participation in the Giveaways in the event we determine that you are not eligible.

General Requirements

• By entering the Giveaways, you agree to be bound by these terms and conditions. Entry into the Giveaways will be deemed as acceptance of these terms and conditions.
• Unless otherwise stated on a relevant website/landing page/social media post, the Giveaways are one entry per person. Only one entry will be accepted per person. Multiple entries from the same person will be disqualified. MacPaw reserves the right to exclude any participants who breach this rule.
• By entering the Giveaways, you agree to allow MacPaw to share your personal information (e.g., name, email, address, phone) with the company or service so that in case of a win, your prize may be shipped to you directly;
• By entering the Giveaways, you agree that we may use your personal information to provide you with info on the Giveaways (e.g., participation instruction, winners announcement);
• By entering the Giveaways, you agree to share your name/nickname publicly (i.e., it will be included in the email and social media posts) in case of your win so that we could inform participants about the winner and ensure transparency of the Giveaways.

Dates of the Giveaways

The Giveaways shall start and close on the date specified on a relevant website/landing page/social media post. Entries after the closing date will not be allowed.

How to Enter

The route to entry for the Giveaways and details of how to enter will be described on a relevant website/landing page/social media post and will be sent to participants via email.

There is no entry fee and no purchase necessary to enter the Giveaways.

Winner Selection

The process of a winner selection will be explained on a relevant website/landing page/social media post. Unless otherwise stated on a relevant website/landing page/social media post, the following will apply.

The winner will be chosen at random from all entries that are considered to be eligible. The winner will be notified by email and/or direct messages through social media and/or letter within 5 days of the closing date. If the winner cannot be contacted or do not claim the prize within 14 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner. Our decision in respect of all matters to do with the Giveaways will be final and shall not be subject to review or appeal by any entrant or by any third party.

Winners will be chosen at random by randomizer software from all entries received and verified by MacPaw.

We will notify the winner when and where the prize can be collected/is delivered using the contact information you provided us with.

Prize

The promotional prize shall be indicated on a relevant website/landing page/social media post. The prize is as stated, and no cash or other alternatives will be offered. The prizes are not transferable. We reserve the right to substitute any prize with another of equivalent value without giving notice.

Personal Data

By participating in the Giveaways you agree that we may use the winner's name in any manner and any medium for its promotional purposes without additional approval or compensation being required, including posting in a winner's list, social media posts, etc.

Limitation of Liability

By entering the Giveaways you agree to release, discharge and hold harmless MacPaw, its affiliates, its legal representatives, respective officers, directors, employees, and agents from any damages whatsoever suffered or sustained in connection with the Giveaway or the acceptance of the prize.

MacPaw shall have the right, at its sole discretion and at any time, to change or modify these terms and conditions. Such change shall be effective immediately upon the publication thereof. The same applies to the details published on relevant website/landing page/social media post.

We are not responsible for inaccurate prize details supplied to any entrant by any third party connected with the Giveaways.

We are not responsible for any inaccurate personal information you provided us with.

No Endorsement

The Giveaways are in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, or any other Social Network. You are providing your information to MacPaw and not to any other party. The information provided will be used in conjunction with the following Privacy Policy found at Setapp's website.

Governing Law & Dispute Resolution

The validity, construction and performance of these terms and conditions shall be governed by the laws of the Republic of Cyprus, and the Parties agree that any dispute arising from it shall be litigated only in the courts of the Republic of Cyprus.
